License hearings

Your license has its own case, and its own deadline

After a DUI arrest the state can suspend your license whether or not the criminal charge goes anywhere. You can ask for a hearing to contest it, but only within a short window after the arrest.

The number of days depends on the state and on how you were notified, so treat the paper you were handed as urgent. Rania files the request, gets the officer's records, and at the hearing questions the officer about the stop and the test. If a suspension does start, she'll explain any way to keep driving to work, such as a restricted license.

Timeline

From the arrest to the hearing decision

  1. 01

    Step 1: The arrest

You're given notice that your license will be suspended, often on a single sheet that's easy to lose.

  2. 02

    Step 2: The request

A hearing has to be asked for inside the window. Rania files the request the day you hire her.

  3. 03

    Step 3: The records

She gets the officer's report, the test records and any video before the hearing date.

  4. 04

    Step 4: The hearing

She questions the officer under oath. What's said there can matter later in the criminal case too.

  5. 05

    Step 5: The decision

A judge rules on the suspension. If it stands, she'll walk you through any restricted license.
